Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") are a legally binding agreement between you ("User," "you," or "your") and Barkopalooza LLC ("Company," "we," "us," or "our") regarding your use of MoreGej, a CRM application operated by Barkopalooza LLC, the moregej.com website, and related services (collectively, the "Service").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility

To use the Service, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into a binding agreement

3. Account Registration

3.1 Account Creation

You must have an account to use the app. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password and two-step sign-in method secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

3.2 Account Termination

We may suspend or terminate your account if you:

  • Violate these Terms
  • Provide false or misleading information
  • Engage in fraudulent or illegal activity
  • Fail to pay applicable fees

4. Description of Service

MoreGej is a customer relationship management (CRM) and activity tracking platform designed for mortgage teams. Features include:

  • Contact and deal management
  • Activity tracking and scoring
  • Calendar synchronization with Google and Microsoft
  • Email metadata tracking (opt-in)
  • Social media activity monitoring
  • Performance analytics and reporting

Information on the moregej.com website is general and may change. It is not an offer, and any pricing or service terms for your company are set in your subscription or written agreement.

5. Subscription and Payments

5.1 Subscription Plans

The Service may offer free and paid subscription plans. Paid features require an active subscription.

5.2 Billing

  • Subscriptions are billed in advance on a recurring basis (monthly or annually)
  • You authorize us to charge your payment method for all applicable fees
  • Prices may change with 30 days' notice

5.3 Refund Policy

  • You may cancel your subscription at any time
  • Upon cancellation, you will receive a pro-rated refund for the unused portion of your current billing period
  • Refunds are processed within 5 to 10 business days to your original payment method

5.4 Free Trials

If offered, free trials automatically convert to paid subscriptions unless cancelled before the trial ends.

6. User Data and Privacy

6.1 Your Data

You retain ownership of all data you input into the Service ("User Data"). By using the Service, you grant us a limited license to use, process, and store your User Data solely to provide the Service.

6.2 Privacy

Our collection and use of personal information is governed by our Privacy Policy at moregej.com/privacy.

6.3 Data Security

We use reasonable security measures to protect your data, described at moregej.com/security. No system is completely secure, and we cannot guarantee absolute security.

7. Third-Party Integrations

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10.2 No Professional Advice

The Service provides tools for tracking business activities. It does not constitute financial, legal, compliance, or other professional advice. You are responsible for your business decisions and for your own regulatory compliance.

10.3 Third-Party Content

We are not responsible for the content, accuracy, or practices of third-party services or websites linked from the Service.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM
  • WE ARE NOT LIABLE FOR ANY LOSS OF DATA, PROFITS, OR BUSINESS OPPORTUNITIES

Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless Barkopalooza LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your User Data

13. Dispute Resolution

13.1 Informal Resolution

Before filing a formal dispute, you agree to contact us at support@moregej.com and attempt to resolve the dispute informally for at least 30 days.

13.2 Governing Law

These Terms are governed by the laws of the State of Illinois, without regard to conflict of law principles.

13.3 Jurisdiction

Any legal action arising from these Terms shall be brought exclusively in the state or federal courts located in Cook County, Illinois.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms and updating the "Last Updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service, unless your company has a separate written agreement with us, which then controls.

15.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full effect.

15.3 Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

15.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
